Terms and Conditions

Please read our Terms & Conditions before making your application (a printed copy of the Terms &Conditions can be obtained by emailing info@worthingartistsopnehouses.com)

By submitting your entry form to Worthing Artists Open Houses you are agreeing to accept these Terms & Conditions.


Terms

WAOH – refers to the activities for Worthing Artists Open Houses in the management and organisation by the Steering Group and owner of the website worthingartistsopenhouses.com

Steering Group – refers to the named members of the Steering Group available on request

Artists / Venues – means any individual, organisation, or business involved in the activities of the Worthing Artists Open Houses event as listed on the WAOH website and any other promotional material

Venue Hosts – refers to the main contact of each registered venue

Event – refers to the activities held by WAOH, usually over three weekends held annually

Premises – refer to the named site (as per address provided by the Venue Host) where artist/s and their work are exhibited during WAOH

Community Partner – refer to those organisations who support the activities of WAOH either in kind, or through promotional or other support

Agreement

The Worthing Artists Open Houses purpose is to facilitate an opportunity for practicing Artists/Venues to display/sell their own work in a venue registered for the Event.

The Event is open to Premises in the BN11 – BN14 post code areas. (It is understood the work of artists from outside this area may be exhibited in the Premises during the Event)

Commercial organisations are able to take part in the Event, but the images and words used in WAOH listings must be solely relevant to the exhibition of artist work at the Premises. WAOH listings must not be used to promote a business or other unrelated business activities. It is understood that the name of the business can be used in the listings if it is in the address of the Premises being used for the Event.

Artists/Venues will be responsible for the exhibition of their own work at each Premises, health & safety, insurance, curation and invigilation during the Event and must ensure that all these elements are sufficient for the efficient management of the Premises during the Event. The Steering Group can take no responsibility whatsoever for any loss or damage, howsoever incurred. Artists/Venues participating in the Event should ensure that all information they provide in relation to the Event is be up to date and accurate and relevant to the Event.

All applications must be made and received by WAOH within the publicised time scale each year. An application will only be deemed completed when full monies are paid and cleared, and all required information has been received.

Participation fees will be determined each year, and notified by the Steering Group and will remain at the level notified for the duration of the Event.

Artists/Venues enter an agreement to ensure their participation in the Event is fully met through the exhibition of work at the Premises as notified by the Venue Host and advertised for the Event, specifically on the leaflet and website. Where unforeseen circumstances affect the ability of the Venue Host at the Premises to meet these obligations, this must be notified to the Steering Group as soon as possible and alternative arrangements put in place and notified through the website.

Venues/Artists agree to work co-operatively for and during the Event, contribute to tasks, sharing information and engage in the positive promotion of the Event in support of WAOH.

In coordinating and administrating the Event, the Steering Group will regularly consult with, and seek the views of Artists/Venues through appropriate communication channels and remain, as far as is reasonable, responsive to Artists/Venues needs. However, in coming to decisions regarding the type and extent of services provided, and the nature of the direction and future development of WAOH, decisions reached by the Steering Group will be contingent on the needs and interests of the Event as a whole, rather than the interests of any particular group. Discussions and recommendations arising from meetings are advisory only and are not binding to WAOH or the Steering Group in any way.

The Steering Group will provide participating Artists/Venues with regular feedback and information regarding the provision of services, fees and any changes to the Event, via appropriate communication channels, such as meetings, newsletters, and email communication.

 

WAOH will aim to provide the following activities in support of the Event. (WAOH reserves the right to change these services from year to year):

  • Your venue listed in the WAOHprinted leaflet/brochure (23000+), distributed throughout local and regional distribution points.

  • Your venue listed on the WAOH website

  • Social media campaigns, on various sites, for the Event

  • To work with Community Partners, in the reciprocal support and promotion of appropriate activities for the Event

  • Appropriate support and advice offered as available to Artists/Venues for the Event

  • Regular newsletters and information sent to artists and visitors as part of WAOH

  • Promotional activities in appropriate local and regional newspapers, magazines and listings

  • General meetings for Artists/Venues

  • Online guide for Venue Hosts

  • Opportunity to mentor artists involved in the Event

  • Networking opportunities for Artists/Venues

  • Collection/collation of feedback from visitors, exhibitors and workshops

 

Publicity

Artists/Venues are expected to contribute to the positive promotion of WAOH, and the Event, using WAOH branded promotional material.

Venue Hosts should ensure that WAOH promotional material is displayed prominently during the Event and removed promptly after the Event (and returned to the Steering Group where applicable)

When producing own promotion/publicity materials, Artists/Venues must include an official WAOH logo, which can be obtained from http://www.worthingartistsopenhouses.com/press-media/

Charges & Payments

All listings fees are paid per venue – there is no limit to the number of artists exhibiting in one venue, nor are any other obligatory extra fees charged.

The fees are currently set at:

  • 95.00 for all Venues

The Steering Group reserves the right to change fees, but will ensure that fees notified for the Event will remain at that level for the duration of that Event.

The fees need to be paid in full by the date that will be advertised on the website and news-letter. Payments are non-refundable.

WAOH charge no commission on artists’ own sales during the event or subsequently.

WAOH reserves the right to refund payment and withdraw any entry that does not, after due consultation and consideration, comply with our Terms and Conditions.

 

Racist, homophobic, sexist, ageist or language abusive to people with learning or other needs will not be accepted and the right to register for the Event will be withdrawn. All venues should meet their requirements under the Equality Act 2010, especially with reference to access activities at the Premises.

Insurance

Every Venue Host ensure that the appropriate level of insurance is in place for the duration of the Event at the Premises. WAOH and the Steering Group will take no responsibility for injury to members of the public or artworks when visiting Premises during the Event.

Visitors to the WAOH Venues listed on our website and on our promotional material do so entirely at their own risk. Adults are responsible for the supervision of any children in their care. Those involved in this event or our website cannot accept liability for any loss, damage or injury sustained by any member of the public during visits to the venues listed. Visitors should be aware that some venues can be hazardous because of the presence of sharp tools, chemicals and machinery. Children are any individual aged 18 or under.

Leaflet/Website

WAOH intends to provide a profile for each Premises for the purpose of the Event on the website and leaflet only. Venue Hosts are responsible for the timely delivery and accuracy of requested details.

WAOH will supply Venue Hosts with a proof of the WAOH leaflet. Any errors/adjustments must be sent to info@worthingartistsopenhouses.com within the given timeline.

WAOH cannot accept responsibility for any errors found after this deadline. The final decision on the use of images and copy for the website and leaflet will be made by the Steering Group to ensure the overall branding and style of WAOH is maintained through these promotional activities.

Participating Venues are required to submit one image and text for inclusion in the annual leaflet and WAOH website.

All supplied images should be of a good standard and adhere to the following specifications:

  • File format:        JPEG/TIFF

  • Dimensions:      Square images. One image per frame, no composites.

  • Resolution:        The image resolution should be minimum 1200 pixels, at 300dpi

  • Image Title:       Each image must be CLEARLY labelled with the artist’s name.

 

Composite images – where a single image is made up of several smaller ones – will not be accepted.

Copyright and Use of Materials

Artists/Venues agree to their images being used in selected promotional materials (including website, social networks and other media) unless agreed otherwise. The Steering Group reserves the right to use selected images and copy for promotional activities other than the leaflet and website in order to promote the Event as appropriate to the medium that the promotional activity is due to be published.

Please make sure that any text, graphics, photos or other media that you provide to WAOH and any third party is either owned by yourself or that you have permission to use them.

Any material submitted by Artists/Venues must not infringe any applicable laws or contain inappropriate content (such as indecent, offensive, defamatory or threatening material). Artists/Venues also agree to indemnify WAOH against any claims, costs and expenses for any material used at your request.

WAOH reserves the right to review submitted listings and change details which do not comply with the WAOH house style, or which are felt to be untrue or offensive.

Licence to Use Website

Artists/Venues may view, download for caching purposes only, and print pages from the website, provided that material from this website:

  • is not republish (including republication on another website)

  • is not reproduced or stored in any public or private electronic retrieval system;

  • is not reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for a commercial purpose, without our express written consent;

  • is not edited or modified.

 

Changes to the Terms & Conditions

The Steering Group reserves the right to make changes to these Terms & Conditions. All changes will be notified and posted on this page or, where appropriate, notified by email/newsletter. This version is 1.6 and dated 01/04/2024

WAOH is committed to Privacy and Data Protection

WAOH collects personal contact information (including name, address, telephone number and email address) which you provide on a voluntary basis.

Contact details are used to follow up on your requests and keep you posted on WAOH latest news, offers and available services. If you don’t want to be on our mailing list, you can opt out anytime by sending an email to info@worthingartistsopenhouses.com

WAOH will not share your personal information with third parties for any other purpose without your consent, unless required by law.

 

Any personal information we collect will never be sold to any companies or individuals. If you have supplied contact details to WAOH and thereby given your consent, you may be sent relevant news, special offers or other information you have expressed an interest in, or which might be of interest to you.


Service Providers

WAOH may employ third-party companies and individuals due to the following reasons:

  • To facilitate our Service;

  • To provide the Service on our behalf;

  • To perform Service-related services; or

  • To assist us in analyzing how our Service is used.

 

Selected third parties might have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
